1. Our Service

Information provided through the Service is not intended for distribution to or use by any person or entity in any jurisdiction where such distribution or use would be contrary to law. Persons accessing the Service from other locations do so on their own initiative and are responsible for compliance with local laws.

2. Intellectual Property Rights

Our Intellectual Property

The Company owns or licenses all intellectual property rights in the Service, including source code, databases, functionality, design, text, and graphics (the “Content”), as well as trademarks and logos (the “Marks”).

The Content and Marks are provided “as is” for your personal, non-commercial use or internal business purpose only.

Your Use of the Service

Subject to your compliance with these Terms, including the “Prohibited Activities” section, the Company grants you a non-exclusive, non-transferable, revocable licence to access the Service and to download or print a copy of any Content you have properly accessed, solely for personal, non-commercial or internal business use.

Any other use of the Content or Marks requires the Company’s prior written permission. Requests should be addressed to ab@tyver.io.

Breach of these intellectual property rights constitutes a material breach of these Terms and will result in immediate termination of your right to use the Service.

3. User Representations

By using the Service, you represent and warrant that: (1) all registration information you submit is true, accurate, and complete; (2) you will keep it up to date; (3) you have the legal capacity to agree to these Terms; (4) you are at least 18 years old and have reached the age of majority in your jurisdiction of residence; (5) you will not access the Service via automated means (bots, scripts); (6) you will not use the Service for any unlawful purpose; and (7) your use will not violate any applicable law.

4. User Registration

You need to register to use the Service. You are responsible for keeping your password confidential and for all activity under your account.

5. Purchases and Payment

The Company accepts the following payment methods via its payment partners:

  • Card payments (cards supported by Stripe) — processed via Stripe
  • Cryptocurrency payments — processed via Inxy and/or Heleket

The Company does not store or directly process your card or crypto wallet details — this data is handled by the above payment providers in accordance with their own privacy policies.

You agree to provide accurate, current payment information and to keep it updated. All payments are made in US dollars. The Company may change prices (see Section 6) and may refuse to process an order if it suspects fraudulent or suspicious activity or a breach of these Terms.

6. Subscriptions

Plans and Billing. The Company offers subscriptions billed monthly, semi-annually, or annually — see the pricing page for current terms.

Renewal. If you pay by card, your subscription automatically renews for each period via Stripe, charging your payment method, unless cancelled in advance.

If you pay by cryptocurrency, automatic renewal is not supported: each payment is a separate, one-time action that you complete yourself. The Company does not send reminders as your paid period approaches its end — it is your responsibility to renew on time. If payment is not received before the end of the current period, access to the Service is restricted immediately.

Cancellation. You may cancel your subscription at any time via your account. Cancellation takes effect at the end of the current paid period.

Fee Changes. The Company may change subscription fees. We will notify you in your account before you are charged at the new price; until then, you may cancel your subscription.

Money-Back Guarantee and Right of Withdrawal. Within 14 days of each subscription payment, including automatic renewals, you may cancel that purchase without giving any reason and receive a full refund by emailing ab@tyver.io. For EU consumers, this also constitutes the right of withdrawal under Directive 2011/83/EU. You may use the model withdrawal form in the Annex, but you are not obliged to. Refunds are made to the card or crypto wallet used for the payment. Crypto refunds are made in the same amount as paid; the Company covers the network fee.

Tyver Coins. Tyver Coins are the Service’s internal currency. They can be used to pay for generations in the AI editor and for other paid features of the Service where this is provided. Coins do not expire. Purchased coins are non-refundable and cannot be exchanged for money.

7. Prohibited Activities

You agree not to: share account access or engage in multi-accounting; systematically scrape or compile data from the Service without written permission; deceive the Company or other users, including to obtain passwords; circumvent or disable security features; disparage or harm the Company or the Service; use information from the Service to harass or harm others; behave abusively towards Company staff or submit false reports; use the Service in violation of applicable law; engage in unauthorized framing of or linking to the Service; upload viruses, malware, or spam; use scrapers, bots, or automated data-mining tools; remove copyright notices; impersonate another user; deploy passive data-collection mechanisms (web bugs, tracking pixels, spyware); place undue burden on the Service’s infrastructure; bypass access restrictions; copy or adapt the Service’s code; reverse-engineer the Service except as permitted by law; or use the Service to compete with the Company or for purposes not contemplated by these Terms.

8. Feedback and User Contributions

The Service is not a platform for publicly publishing user-generated content. If you send the Company feedback, suggestions, or other input about the Service (“Submissions”), you agree that the Company may use such Submissions for any purpose without compensation to you, and you warrant that your Submissions do not infringe any third party’s rights.

Where the Service allows you to save, tag, or share materials within your account (e.g., saved ads), such use remains subject to these Terms. You are solely responsible for complying with applicable law and the terms of the original platforms (e.g., Meta/Facebook) when working with third-party advertising content displayed through the Service.

9. Contribution Licence

By submitting suggestions or other feedback about the Service, you agree that the Company may use and share such feedback for any purpose without compensation to you.

10. Third-Party Websites and Content

The Service may link to third-party websites and content. The Company does not review or take responsibility for the content, accuracy, or privacy practices of such third-party resources. You access third-party sites at your own risk.

11. Services Management

The Company may monitor the Service for violations of these Terms, restrict access, remove content that violates these Terms, and otherwise manage the Service to protect its rights and ensure proper functioning.

12. Privacy Policy

By using the Service, you agree to be bound by the Company’s Privacy Policy, which is incorporated into these Terms by reference. For details on where and how your data is processed, including international transfers, see the Privacy Policy.

13. Term and Termination

These Terms remain in effect while you use the Service. The Company may, at its discretion and without prior notice, restrict or terminate your access to the Service, including for breach of these Terms or applicable law.

14. Modifications and Interruptions

The Company continuously develops the Service and may change its features. The Company strives to keep the Service stable, but scheduled maintenance and technical issues may occur.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of Cyprus. If you are a consumer habitually resident in the EU, you additionally retain the protection afforded by mandatory provisions of the law of your country of residence. Disputes are heard by the courts of Limassol, Cyprus. If you are an EU consumer, you may also bring proceedings in the courts of your country of residence.

16. Dispute Resolution

Informal Negotiations. The parties agree to attempt to resolve any dispute informally for at least 30 days before initiating arbitration or court proceedings.

Arbitration (business users). If you use the Service for business purposes, disputes arising from these Terms will be determined by a single arbitrator appointed in accordance with the Arbitration and Internal Rules of the European Court of Arbitration (part of the European Centre of Arbitration, Strasbourg). The seat of arbitration shall be Limassol, Cyprus. The language of proceedings shall be English. The applicable substantive law shall be the law of Cyprus. EU consumers resolve disputes in court (Section 15).

Exceptions. Disputes concerning intellectual property rights, confidentiality breaches, or claims for injunctive relief are not subject to informal negotiation or arbitration and will be resolved by a court of competent jurisdiction as described in Section 15.

17. Disclaimer

The Company does its best to keep the Service stable and accurate, but cannot guarantee that it will be completely error-free or suit every purpose you may have. This does not limit your statutory rights as a consumer: if the Service does not conform to the contract, you are entitled to have it brought into conformity, to a price reduction or to terminate the contract.

18. Limitation of Liability

The Company is not liable for indirect losses, such as lost profits. This does not apply to damage caused intentionally or through gross negligence, or to consumer rights that cannot be limited by law.

19. Indemnification

You agree to compensate the Company for losses, including reasonable legal costs, arising from your: (1) breach of these Terms; (2) breach of your representations and warranties (Section 3); (3) infringement of third-party rights — for example, uploading someone else’s content without permission; (4) intentional harm caused to other users of the Service.

20. Modifications to the Service, Outages, and Refund Claims

20.1. The Company may restrict access to the Service if you breach these Terms.
20.2. The Company may temporarily restrict access during maintenance.
20.3. The Company is not responsible for outages caused by the user’s ISP or third-party data centers.
20.4. Refunds are issued only for outages lasting over 24 hours caused by issues on the Company’s side (e.g., infrastructure failures, power outages). Compensation is proportional to the subscription plan and outage duration.
20.5. Refund claims for outages must be sent to ab@tyver.io within 14 days of the occurrence.
20.6. Refunds are processed within 14 days to the original payment method.
20.7. If you would like a refund for any other reason (beyond the money-back guarantee in Section 6 or an outage caused by the Company), email ab@tyver.io — the Company will review each request individually.

21. User Data

The Company maintains data you transmit through the Service for the purpose of its operation. Despite regular backups, you are solely responsible for all data related to your activity on the Service.

22. Electronic Communications, Transactions, and Signatures

Visiting the Service, emailing us, and completing online forms constitute electronic communications. You consent to receive electronic communications and to the use of electronic signatures, contracts, and notices in connection with the Service.

23. Miscellaneous

These Terms and any policies posted by the Company constitute the entire agreement between you and the Company. If any provision is found unenforceable, the remaining provisions remain in effect. No joint venture, partnership, employment, or agency relationship is created between you and the Company by these Terms.
